Cowley Chartered Surveyors regularly receive appointments by Solicitors and Members of the Public to act as Mediators or Independent Experts.

At one time, the parties to a dispute would appoint their own Surveyor to act on their respective behalf, with the result that the two Surveyors may not agree, and could run up significant costs for Clients, in addition to rising Legal costs, in negotiating with the other side.

More recently, new protocols dictate that where possible, Solicitors or the Parties to a dispute try to agree the appointment of a single Joint Expert, whose report is binding, and which must be prepared by a Surveyor who is regarded as an Expert in their field, and who will produce a report which is accurate and impartial, and above all, which is to be helpful to a Court in assisting it making a judgement on a case.

The result of this revised protocol is significantly reduced Legal and Professional costs, and as the report is to be relied upon by all parties, the Expert is often not required to attend Court to be cross-examined. However, both parties Solicitors are able to raise questions of the Surveyor if they think fit.
